Next time use checks to pay for your rent so you will have the proof. BTW what did you do to make your landlord so angry at you? Does he have the right reasons? Landlords do not kick out their tenants UNLESS thay have a reason.*I need some legal advice. Please Help!!!!?
show your power receipts to the judge and ask for a receipt from the landlord for rent. I would just move though because I dont like being under subjection of an aszhole who at anytime may get the sheriff to remove my property and place it on the street where it will become imminent domain and anybody can take it.
In my own state an eviction is initiated by written notice from the landlord. If you dispute the reasons for the eviction you have 15 days to repond to the notice.
A court date is then established where the court will settle the issue. Best have receipts, witnesses, and any other support on your behalf to show you have been slighted by this landlord.
Check with your county clerk of the court to insure you have the right information concerning evictions in YOUR state!
Best wishes.
Learn not to pay cash or keep your receipts. How would any of us know whether you are lying or not. Maybe you both consider yourselves 'christians' so who knows.
I am a Christian but my slogan, from experience is; 'God, please spare me from the self-proclaimed born again Christians'. They have hurt me beyond all others.
This has nothing to do with religion. This has to do with you not having receipts and paying cash. You are naive at the least. Go set up a checking account, and really do you want to be living there anymore? Always get a receipt and always pay by check so you have a record. When you put your deposit down, always have it jointly in your landlords name and yours, and put it in an interest bearing account.
Well depending on the area you live in, there is an ammount of months that if you get kicked out if you don't pay your rent. For example, if you live in Chicago, you have the right not to pay rent for six months. If you decide to pay your rent on the seventh month the landlord CANNOT evict you.
Do you have a contract with your landlord? If you payed cash for it, where is the proof? Do you have at least a paper that states that you did pay your landlord?
What kind of idiot pays cash for rent without receipts???? You have to take care of yourself, ya know????
well the magistrate could look into the landlords financial records and see if there is anything funny like extra money on there unaccounted for and as long as you have your power receipts to show proof. but you need a lawyer and stop paying in cash! use a money order, cashiers check or even make the dirty landlord sign a piece of paper showing he received money and always have a witness! good luck
you should have reciepts for your rent if you pay in cash, they are proof enough, otherwise get yourself a good lawyer
It sounds like he is greedy and is trying to exploit you. By paying cash you make an easy target. He might be able to do this to you, and get you evicted. You may have to just learn for this mistake.
The good thing is, is that he will have to have the burden of proof and not you. You need to however is get a rent receipt next time you pay. Even if this is true, it will take several months for him to actually have you evicted. I mean atleast 3 to 6 months. What I would suggest is this: if he is saying you not paying rent, then dont pay him. Let him continue on this and you live rent free until he is successful in getting you kicked out and by that time you will have enough money saved to move to another place. I would let him do it, take the rent money that you would pay him and save it. I hate landlords. My landlord is nice, but at the same time he is always in my house! Good Luck and dont let it bother you, in the long run he is gonna lose a lot of money.
You should have never paid the rent in cash without any receipts. That is the stupidest thing to do. So now your landlord can very well sue you for the back rent because u don't have any proof that you have paid your rent. But as far as the power issue is concerned i think he cannot lie about that because u have the proof, that is, the receipts. You can show them to the magistrate. Just remember that you should never trust anybody as far as money matters are concerned because people can always lie and whether a person is a true christian or not that is something you or I can never tell. So next time just be cautious and always ask for a receipt if you are paying in cash.
if hes lying ofcourse its not legal but you are not doing much to help your case.
First you have electricity bills...good...keep them
Second you never, ever pay a bill in cash and not get a reciept. Its your word against his...and the burden of proof is on you...you have to show you pay rent.
