There was use of a credit card, im unaware of the amount which was spent on the card or cards, but a detective is requesting she sit down %26amp; talk 2him. He says he has video footage of the actual card (s) being used, but i dont know how credible only a picture is, if this is all the evidence they have? The detective insists this will all be easier with their cooperation, but is there a risk of incriminating himself if he does speak 2the detective? I dont think obtaining a lawyer is a possibility at this point. It's financially impossible at the time. So any feedback %26amp; knowledge on this topic would be helpful, %26amp; please take into consideration the information i provided you with. Just my thoughts on this---I have no legal opinion to give.
I would not talk, she has absolutely nothing to gain and everything to lose. The burden is always on the government to prove the crime. Why on earth would she want to cooperate with them is beyond me. Does she think they will be nice to her after she makes incriminating statements LOL.
If they already had the evidence they would have arrested her; they are probably planning on it. She will have a lawyer appointed by the court upon being charged, if she cannot afford one. She should not talk even if she is taken into custody, just say she wants to talk to a lawyer first; during arraignment she will get a lawyer appointed. Once she tells the detective she will not talk, because she wants a lawyer first; he must stop asking anything having to do with the crime.

If they have the video they would also have a report from the credit card company that indicates which credit card was used when the purchase was made. So they have a video of her making a credit card purchase and a report from the credit card company showing the stolen card was used at the same time and place.
That puts her in possession of the stolen card and shows her using the card.
A lawyer is always an option. As they say when you are arrested ';...If you can not afford one, one will be appointed to represent you...';
Footage that synchs with bank records at the exact moment of a purchase is compelling evidence.
And not talking to the detective is only delaying the inevitable.
