I have recordings and adresses of companys calling me about some offer. I make them say the date/time and i plan to get phone records.
Questions.
1. How do I file a small claims suit against the company? How much are legal fees in san diego, California?
2. Can i still sue if the telemarketer was asking for a different person (previous owner) or the homeowner (im the homeowners son)?
3. If they persist on the first call on their offer, can I still sue them for $500?
4. Can i sue my own cellphone carrier for sending me Text Spam? Virgin mobile sends text messages to my phone, and they are my carrier. Its Automated. And i think costs me. And they did tell me NO CONTRACTS
5. Can I sue multiple companies at once?
6. Do Surveys Count? Or are they unsolicited advertisements?
7. How do i request phone records? Do I call my service provider?
8. Any advice to make my case stronger?

Wow, you really pulled this one out of your ***. I think im proud. Now, first of, this is deff. a small claims court thing. Survey's don't count, they're not trying to sell you anything. Neither does Virgin Mobile, those text messages are free. A pain in the ***, but free. You could sue multiple companies at once but it might weaken your case that you're crusading against 10 different telemarketers at once, However it might be better to get it all done in one sitting. Call your service provider and just request your phone records. I'm guessing its a cell phone, which is why you're suing. um...You can only sue, regaurdless of who they asked for, i you've already asked for them to put you on the do not call list. In most states, making use of tape recordings made without the other party's consent is illegal. I think your tapes will never be accepted in court and you just may find yourself in sued or in jail.
