So, at my apartment, I'm currently 1 month behind. My neighbor right beside me has fallen as far as 5 months behind and repayed with no late fees. She used ';I'm waiting for financial aid to pay';. Well, recently, the maintenance guy has been coming into my apartment WITHOUT my permission and while I'm at work. They originally told me there would be no one in my apartment without my consent. Also, this morning I got a call with an warning of eviction if I didn't straighten out my debt. Well, as it turns out, my neighbor(s) knew that I was going to get this warning well before me.
Is all this legal or can I fight it?Legal advice needed concerning my landlord...?
You have no basis for complaint. You appear to be reaching for some 'legal excuse' to retain tenancy when you are 30 days past due on your rent. It won't work. Unless you are a current paid tenant, the courts will rather laugh at your contentions, and will easily see what you are attempting.

Legal, although the maintenance guy entering when you are not there is questionable depending on the terms of your lease. But if you are 1 month behind then they can threaten you with eviction- but it is just a scare tactic.

so in two days you're going to be late on two months rent.
they should have sent you a letter before they told your neighbor
but they don't have to let you stay

what your landlord or repairman told your neighbour about you are late in payment or about to be evicted isnt nice, but it is not a ground for lawsuit because what was said was true and not a libel or with intent to mislead etc.
with respect to getting into your apartment without your permission,the landlord may say that (a) they called you, but u werent home or didnt return call, or (b) the repair was urgent... Still, not ground for lawsuit.
If your Landlord is violating your lease, prove it for your right to terminate your Lease, but at least be paid up when you do. They are two separate issues.
Fight what?
If you are a month behind on rent, you can be evicted. You should have gotten a 3 day notice to pay or quit on the 6th of September.
Instead of looking for reasons to sue or get out of paying your rent or whatever it is you are wanting to *fight*, I would get caught up on September's rent and pay October's before the 5th. Just because they let the neighbor slide for 5 mos and not pay any late fees doesn't mean: A) it is even true, you have no idea what the real story is between the neighbor and the landlord and B) they would treat you the same if they did let the other neighbor get away with renting for free for 5 mos.
