Legal advice on mortage payment obligations?

I went to TCF bank to pay my TCF mortgage payment for September that is due on the 28th of each month. I paid on the 6th of October, which is with in the 10-day grace period. I had to pay with a cashiers check from Wells Fargo. I received a receipt from wells Fargo for the cashier鈥檚 check and then a receipt for the payment to TCF. I get a call from several people at TCF stating that they have not received my payment. I told the last person I would fax her a copy of my receipts. My question is have I fulfilled my legal obligation to pay my mortgage payment by faxing them the receipts and can I tell TCF that it is there problem if they lost the check. I do not believe I should have to incur any additional expense to correct this issue. Thank for any and all advice.Legal advice on mortage payment obligations?

No, you did the right thing already. If you have the cashier's check receipt and a receipt of payment you might want to make a photocopy to give to the bank, and take the originals in to show someone right away. NEVER hand them the originals. YOU need those.





This happened to me once with my car payment. The bank said that I never paid them, but I took in my receipt of payment and they sorted it out.





Banks can screw up, and they regularly do. However, in my experience they rarely like to admit it. That's modern customer service for you!
You have not technically fullfilled your obligation until they confirm they have the money in hand. You faxed the info over, but if they don't have the cashiers check, you may have to stop payment on it, and go get another one from wells fargo. I know it is a hassle, but banks are terrible.
