I have a family member who is in need of legal advice. Here is the situation...(his name is chris)
Chris was hanging out with a friend *john and John invited his friend *mike to hang out with them. Chris did not know mike before this day. Mike brought alcohol over with him in his truck and the three of them were drinking. Mike and John decided they wanted to go to a strip club and continue drinking so Chris tagged along. The Strip club did not I.d and and MIke and JOhn were underage. Chris is 24. They were all served drinks and dances at the club. When it is time to leave Mike starts his truck and Chris and John get in the back. A few minutes down the street Mike decides he is too drunk to drive and hands the keys to a VERY DRUNK CHRIS. Chris starts to drive the truck and crashes it. He is later charged with DUI bodily harm since there was a few broken bones, 6months to county jail, and 14,000 to replace the truck. The judge only sentenced him to 6months because he never had any intentions to drive because it was not his truck and the keys were handed to him after he was severely drunk. A lawyer said he might have a case to lower his 14,000 dollar payment and that Mike should be partially responsible for that. Sorry I know it is long and confusing..But I really want to get some good info for him...Legal Advice Please..?
That is rather harsh considering the owner handed over his keys to him knowing he was intoxicated. However, the law would argue responsibility lays with the one who agreed to take the keys and drive knowing he was intoxicated and unable to drive.
You do however have grounds to launch a civil suite to have the owner culpable for a portion of the costs for his truck.Legal Advice Please..?
Unfortunately your family member did drive drunk. There is no way to get out of that. About replacing the truck, that guy gave him the keys and gave him permission to drive it. I know for a fact that the insurance company will pay for someone else wrecking the vehicle. This happened to me, minus the liquor. The insurance paid me for what my car was worth.
Why would you want to get good 'info' for him? Everyone made bad decisions here. Drinking, going to a strip club, drinking AND driving...you reap what you sowed. And I see you all planted some very bad seeds. I don't feel sorry for any one involved here. You all were making bad choices. You need to just suffer the consequences, suck it up and hopefully learn from it.
Chris is still responsible, drunk or not. Maybe if you get an attorney, Mike would be willing to accept less than the $14,000. If Mike goes before the judge and says he will accept less, the judge might go with that. Chris really needs an attorney.

Chris decided to share alcohol and go to a club with minors, one of which you say he KNEW. Yeah, there are at least as few more crimes here that he hasn't been charged for - yet.
Reading that, I think the lawyer's right. He can't be liable for the damage on his own, but I do think he has 50% culpability. Sorry I can't help more and a pity he took the keys.
sorry dude....mike and john are partially responsible for their injuries if they take him to court...the lawyer is an idiot ....it is a criminal case where he gets paid per hour...
