we just moved out from an apartment building. The lease term we agreed for that apatn=ment was fir 6 months. The welcome note of that lease agreement was written for 6 months. But after that when the document was typed error was made and it was written for 12 months. WE didnt notice that at that time and we moved in after signing the document. But when we were ready to moveout we realised that the welcome note alone is written for 6 months lease and signed by both party. lease and the other documents says 12 months. we were shocked and approached the person who worked for us to move in. He agreed the mistake and said yes , i remember and the welcome note has my signature on it. so you can move out without paying a penny. Trusting that we moved out. Now the apartment office is charging us a lease brekage amount of 1581 dollars. The people incharge is not accepting the truth and charging us unneccasarily. We are actually no longer in US. WE moved back to our country.Help!!!Legal advice?
If you don't plan on coming back to the states, you can just forget about it.
You definately should have had the lease agent sign something stating that there was an error made, and that you are not liable. See if you can still get that person to sign a statement like this. If he is not willing, you will have a difficult time fighting it, since there is a signed contract stating the 1 year lease.
You must also be present in court to fight it. However they must file for the judgement in the county that you live in, so that will be rather difficult for them to do.Legal advice?
I am not an attorney first of all, but you do need to look for a real rental property attorney. you would need these documents you as stating that originally have the 6 month lease on it. Having that handy he would probably write a response stating those exact words that you were renting it for 6 months, that you spoke with the person and that he agreed it was a mistake. it will probably be costly since you would be paying fees plus mailing stuff (to and from your country)
what i would do first is call them up, talk to the person u originally had the agreement with and tell them whats going on. if that doesn't work then u do need the attorney.
