Legal advice. What should he do? Very important please help?

My boyfriend and I were at a party one evening and there was this guy (we'll call him Bert) there that neither of us really like, so we tried to ignore him as much as possible. When I was there I saw Bert go into the corner with another guy (we'll call him Ernie) and say ';we're gonna get pretty f*cked up tonight.'; I didn't drink at all, so I remember everything clearly. Bert played beer pong and was partnered up with Ernie. Bert drank the beer as did Ernie. They drank a lot of beer and Bert had already mixed up pepsi and brandy that he had previously made at his house and was already drinking before he got there. I left shortly after. My boyfriend told me that after I left Bert came up to him and tried to throw him down (so Bert started it). My boyfriend got behind him and did a ';rear naked choke'; on him for a few seconds to get Bert to leave him alone. Bert passed out during this and my boyfriend let go instantly. After that Ernie and my boyfriend cleaned up Bert, who was completely wasted and left him alone in the bathroom so he could you know...go. Then they heard a loud crash and they couldn't get the door open because Bert had fell against it, so Ernie had to kick the top part open. when they asked Bert what had happened he had no idea that anything had happened. They laid him Bert down so that he could go to sleep and in Bert's sleep he puked and aspirated in his lungs from drinking so much alcohol. Bert crawled up stairs and told my boyfriend who went to sleep, that he needed to go home. My boyfriend then took him home. Later Bert went to the hospital and the doctors told him that he had cracked his lower spine, but Bert couldn't remember how because he couldn't remember falling because he was so drunk. They told him that he was bleeding out of his lungs from the vomit. Some blood vessels in his face had popped, but that it would go away in time. The doctors also found massive amounts of alcohol in his blood along with a muscle relaxer called Klonopin. Bert took the Klonopin while he was drinking the alcohol. Now Bert wants to sue my boyfriend for all of his medical bills. Do any of you think Bert has a case, if so what should my boyfriend do to win the case. Any opinions or suggestions appreciated.Legal advice. What should he do? Very important please help?
I'm not a lawyer,but I don't believe burt has a case. Is bert prone to being aggressive when he is drinking? From what your story says it sounds like he is. Plus he started the fight between your boyfriend and himself. He also took klonopin while drinking alcohol,and you should take any drugs while drinking alcohol. Especially muscle relaxers which help the body relax so that you can sleep. From what I can tell its all burts fault that he fell an broke his lower spine.Legal advice. What should he do? Very important please help?

Violence is the answer in more ways than one
That is a crazy story. Were there any other witness's other than Ernie? What side is Ernie on? How does Bert feel about Ernie? Who's house was it? Does the owner of the house have home owners insurance? If they rent do they have renters insurance? It is more than likely that he can not sue but he could possibly sue the homeowner. How old is he? How old is your boyfriend? All of these things will play a factor. If Bert is underage he won't sue here is why... he will get busted for all that he did that was illegal. He would be shooting himself in the foot. Did Bert have medical insurance? Interesting story though I would love to see how it plays out.
