This is my question; My daughter and her friend were hurt by a 17 yr old over this past summer.Mine is 11years old hers just turned 9. We took the girls to the Michigan State police, the er and now the girls both recieve counseling. He has a prior record at the time this happened his guardian did not tell us he was on the property. He is the nine year olds cousin and the incident happened at her grandmothers place in her garage. (Grandmother) is the boys guardian. We can't get a straight answer from the authorities or the prosecutors office as to wether or not they have even recieved the case yet.It seems to us that it is being sweep under the rug and the boy is going to get away with what he had done. I cant afford an attorney at this time and does anyone know if legal aide or any other attorney would be willing to help us in this matter?Legal advice concering children/assault?
A few options, which could be used in combination:
1. Confirm that a report was taken. If a report was taken, then it's up to a detective or prosecutor to follow up. So contact the detective or prosector to put pressure on them. Be very nice to them because you want them on your side, but at the same time, continue to put a little bit of pressure on them to take your case seriously. Don't threaten them with, ';If you don't prosecute, I'll... (talk to a lawyer/contact the media/talk to your supervisor/etc.) You can do all these things, but just don't THREATEN to do them.
2. Contacting the media might help, but since it's not a serious crime, I don't know that it will be effective.
3. Talk to a court advocate. There are many victim's rights groups, and they're in almost every location. You could likely find them locally in your phone book, or online through a goole search (or, i guess, yahoo...)Legal advice concering children/assault?
Was it reported to the Department of Childrens Services. You can ask the police if they hotlined it. If they didn't then you can. Just call the child abuse hotline.
Depending on the size of the Police Department, sometimes things seem to move a little slow when we think there should be imediate results. Its just that the case load is so big that it takes their investigators time to get to every case.
Call the hotline and see if they can help..There should be a 1-800 number listed in the front of your phone book.
If you are trying to sue to recover your costs for counselling, medical expenses, etc., you can file that in small claims court yourself without an attorney (if the amount is under $2500).
If you are trying to get the boy arrested, all you can do is call the DA, and just keep bugging them until they act on it.
A quick way to get answers is to go to the local news station. They love this stuff.
what did he do to them ... ?
Call your local news station. This person sounds like a serious predator and needs to be stopped. Once you get the media involved, the cops will have to do something.
