I NEED SOME LEGAl advice?

I SOLD AN ITEM ON EBAY BACK IN MARCH OF 2005.THE PURCHASE PRICE WAS $850.KNOW THE GUY SAYS IT WASN'T WHAT HE PAID FOR.HE CONTACTED THE LOCAL POLICE AND WANTS HIS MONEY BACK.THE LOCAL POLICE TOLD ME TO PAY HIM SO HE STOPS HARASSING ME AND SO THEY DON'T HAVE TO ARREST ME.WHAT CAN I DO.CAN I BE ARRESTED.HE HAS A WEB SITE ASKING PEOPLE TO DO ME PHYSICAL HARM AND PROPERTY DAMAGE.WHAT KIND OF CRIME IS THIS CONSIDERED TO BE.I DON'T HAVE MY RECEIPTS ANYMORE.I NEED SOME LEGAl advice?
1) The local police should not be giving an opinion either way on your transaction, that is strictly a civil matter.





2) If he had a problem it should have been resolved between you, him, and eBay long before now. If it was and he didn't like the outcome, or you didn't follow through on your end, he needs to sue you in small claims court.





3) If the local police told you to pay him just so he would stop harassing you, the may be guilty of aiding extortion.





4) Go to your local district attorney and swear out a harassment and incitement to violence complaint against him. Also get a restraining order. Print out as much of his site as you can and take it with you.I NEED SOME LEGAl advice?
Can't you pull up the page where the offer was made?


Did you sell the item ';as is';?


Sounds like he would have to take you to court anyway. How can the police arrest you without a legitimate charge?


Need more info.
You may have a claim against him for assault and defamation. Have a lawyer write him a demand letter to cease and desist, otherwise you will file legal action against him immediately.

First of all, there is no crime. You do not owe him anything, I don't care what the police say.


There is a one year statute of limitations to file a civil suit for this type of transaction, so he cannot sue you for damage or recovery of the purchase price.


Furthermore, if he set up a web site that is libelous, you can sue him for defamation of character.


Finally, get an attorney and sue this guy. He sounds like a bully.
If you misrepresented the merchandise, then you should pay him back and get it over with.
contact ebay they should be able to help you its been over year they should still have reccords unless you totaly dicieved him

Good Lord Almighty, first of all, I sort of feel like there maybe somethings your not relinquishing in this question. Your case is civil not criminal. Tell this guy to take you court. Call an attorney, I have alot running through my mind so much I cant even pick a starting place. Let's say your being 100% honest here with your question, here's what you do, file a complaint with state against your local policing agencies for their failure to protect you, if they are aware youre being physically threatened that is referred to as simple/common battery, that is a criminal felony. Your complaint will have to be investigated which means paperwork, and writeups, not good for anyone ever. Call the city manager and schedule a meeting with him, bring an attorney to discuss this matter. File for PPO against yor harrasser, contact your circuit court, they will instruct you. Honestly I feel your not being 100%, so good luck. I shouldnt have even told you that much but really if you do what I said you better not have any skeletons in your closet other wise you will be sitting in a 8x8 cell for perjury not to mention your city police will make your life a living hell and will throw the book for wasting their time and government dollars, and a whole other long list of charges not to mention it's a felony type crime so.. you do the math. I am not giving legal advice this my opinion and I highly doubt any attorney would want to touch this question with a 10 foot pole
