No. Because the court system has the power to enforce. There is no protection for you if he renegs; and no protection for him if you allege he is in default.Legal advice please...?
You will still have to go through the court to enforce the agreement. It can be used as a binding agreement. The court will only apply back child support if the father agrees to it. The only payment the father is mandated is from the day the court deems.
If he agrees AND signs off on an official contract with a third party ( notary ) as a witness. The contract is a legally binding exchange of promises or agreement between parties which means that the law can and will in your case, enforce it.
It is better to go through the court system and have a judge take care of the contract, but that other way is still a legally binding contract.
