i got a reckless driving ticket on oct 9th and i had a court date set for the 28th of october. now im being told that it has to be delayed until december because the cop that pulled me over cant make it, i was wondering if i can still somehow get the court date to stay in october because my friend got pulled over before for a reckless and the cop didnt show and she got off...im not too familiar with all the legal aspects but dont i get the right to a speedy trial (or does that not count because its traffic court), and since they didnt care that i go to college 4 hours away from where i got the ticket and the date is set for a tues at 8 AM, shouldnt the cop have to do all he can to come like i do...like i said im not too good with legal details so any advice from anyone with some experience with law is greatly appreciatedLegal advice please ?
i would hope the cop move out of the country - but i would not tee the judge off by requesting the court keep the original date!!Legal advice please ?
You can try to use the argument, but calling a less than two month postponement a violation of the speedy trial rule is going to be iffy at best. As for the time, you are right, they don't care where you will be, you broke the law in their jurisdiction and you have to play by their rules. And not only is the trial set for 8 am, there will probably be people heard in front of you and you could end up spending most of the day there.
