We are selling our boat and this couple left a deposit with us to get it and they were supposed to pay us for it two weeks later. Well after 3 weeks and numerous attempts to contact them they finally emailed us and said that they had changed their mind about the boat and they are wanting their $100 deposit back. we have had many offers for the boat even after they put down the deposit and these people were ready to buy 'right now'. we badly need the money from the boat because of us being behind on bills, but we have waited for the other people. My question is, do we have to give them the deposit back? after they had us waiting and passing up other people's offers all for them to say that they dont want it? please help if you can! Thank you in advance. p.s. they didnt sign anything saying that they were going to purchase the boat. it was just a verbal contract.Legal advice? about a deposit paid???
The sale of a boat falls under the UCC if it is over $500. The UCC requires a written contract for sale of goods over $500 to be enforceable. You have to return the money.
