Ok here is the deal, last year a friend and I moved in together in a apt. when her mom found out she said how about you guys take one of my houses*free of rent* so we jumped on the idea...One night my roomate comes home really drunk and we got into a huge fight!!! it was ugly so the next day I went about my buisness and went to work....When i got home the locks were changed and there was a note sayin'; Ur stuff it in the back of the house'; She through all my cloths everywhere, I still have some furniture in there and I have tried to talk to her and she said when she is ready she will give me my stuff....Its been a year and still nothing..i have emailed her and txt her but no response....What legal action can I take??? I need my stuff back and im tired of her games..Some I need some legal advice...?
Save and get all evidence, take photo's, record conversations.
Keep a diary and include your emotional distress in it.
If you had no pre-agreed upon written contract/agreement or a witnessed verbal agreement you are going to have a hard time proving negligence as you will be considered a ';guest';.
Your leagal claim is for your lost items.
Small claims court is your destiny
Good LuckSome I need some legal advice...?
Judge Judy should hear this case. Seriously though take her to small claims court. She evicted you illegally. You should have called the police immediately after she did this, however you can still call them and ask them to help you retrieve your items. I'm not sure if this will help as they might tell you it is a civil matter.
You can sue for Conversion and get a judgment for the value of the things. Furthermore, you can add the mother as a defendant and ask for leave to put a lien on the house. that would be fun. Or you can ask a third party to mediate and arrange a time for you to get your stuff.
man i feel bad for you, if you can afford it and the items are expensive see a lawyer. he/she can try and get your stuff back. but if the total is only a couple hundreds $ then maybe just leave it. if it cost a lot then hell ye go for it, remember if u win (u have a good case) ur friend will have to pay ur legal cost.
you can sue the mess outta her get your stuff back and she also had no right to throw you out she did not legal evict you as long as you received mail at that location it is tech. your house
You can file a small claims suit against her. She did not give you proper eviction notice therefore you should be awarded inconvenience fees, compensation for your stuff left , also they should award you the court fees. You will have to pay for these up front.
You should have called the cops the first day that she wouldn't let you back in. This is VERY illegal. Even without a written lease, she is still obligated to let you pack your own things and give you notice of eviction.
Your options are a bit more limited now, but I would start by calling the cops. They will be able to suggest other courses of action. They will probably suggest that you file a small claims suit.
