i live in an apartment building and technically we aren't allowed to have pets, however everyone does. i currently have 2 kittens that are very small. the landlord discovered this and sent me a notice saying if i don't get the kittens off the premises, then i can get evicted! is there anything i can do so i can keep both the kittens?
Please if you have any advice, please send a source like a website or excerpt from a book ( if from a book, please include name of book, and author)Please help! I need legal advice!?
Listen i am a lawyer in Greece not in USA (i guess you are from) but i think even though our law is different in many ways, here i think there is something in common! (sorry to dissapoint you but you need an honest advice)
Judging from you saying
'; i live in an apartment building and technically we aren't allowed to have pets, however everyone does'; means there is a ban or odds in your building (supported from the Law of your State i am sure) that you aren't allowed to have pets!So the landlord is covered by the law while you are not!
I am sorry but you make the main mistake that many many many citizens tell me so many times in most of the cases ';BUT EVERYBODY DID IT NOT JUST ME';!
Article 51 of Greek Penal Law (and i would bet my life there is one similar in American Law as well)
(i will translate it the best i can,since i do not know the english terminology of law)
';Commiting illegality and violating the law ,it is equaly wrong for everybody!If others commit the same illegality with you,this does not mean that you have mitigating,but that other people who commited the same crime with you, will get punished under the same regulations';
Uhhhh i tried my best to translate it as good as i could, but you get the picture,you are ';naked'; in front of the eye of law,the fact that others have pets is not a valid ';weapon'; in your case!Please help! I need legal advice!?
If it's in your lease that you can't have pets in your apartment, then you can't have pets in your apartment. It doesn't matter what the other tenants do, he caught you in the act and wants to pursue action. The best you could do would be make other living arrangments if you are set on keeping the cats.
