I'm sued for a car accident for over 30K. My insurance company has arranged a law firm to defend me. The firm had scheduled a deposition hearing and got a letter saying to call a day before to confirm the date. When I called a day before the hearing, the lady who answered the call told me not to come and it has been cancelled and they will let me know if they need any information. Next, the firm sent me a questionnaire on the accident which I completed and sent it back and I got a letter saying my case is scheduled for arbitration hearing.
But 3 weeks before the arbitration hearing I just got a letter from the law firm saying I failed to show up on the deposition hearing and I failed to cooperate pursuant to the terms of the insurance policy. The plaintiff鈥檚 lawyer has been carbon copied on the letter. I called to the law firm two days ago and the told me they will call me and no one has called.
Why would they send me this letter after 2 moths of the deposition hearing鈥檚 scheduled date? Why would they carbon copy the plaintiffs lawyer? Do I need to get another lawyer? What to do? get your bigod ins company local address and take that stuff over to them and get it done in person//stop waiting around and stop calling/take a legal pad with you and take notes/names/dates/places/times//get going before you end up with 30k judgment against you and every body bails out/remember its YOULegal advice on ';failed to appear for your discovery deposition'; letter from insurance company lawyers?
talk to your (insurance company) lawyer first. You need to back up what you're saying as much as possible. Did you get the person's name who told you not to show up? Time and date of the call? If they have scheduled arbitration, after the date of deposition, it sounds like someone's not getting the word!
