3 Months ago i got in a fight with my brother. Im 19, hes 17. It wasnt a big one. I hit him once in the eye, and it left a black eye. At his school, there was a rumor going around that his mom hit him. His teachers phoned the police. The police questioned him about it. After that, they asked him if he wanted to press charges against me. He ofcourse, said No. They asked him if he would testify against me in court, He said no. So after that, Since hes a minor, and Im not, the cop incharge decided he would press charges against me instead.
I ended up being arrested as I was on my way to work. They gave me the full criminal treatment. Im not gonna go over that part, but they did everything in their right they could against me. Even though this is my very first offence at anything.
Here comes the part that im worried about though. The Cop asked me If March 24th was ok. (In Jan). I said fine. And im learning now that since there is no court on that day, They have a warrant for my arrest.Seeking Legal Advice. Cops mistake used against me.?
When an adult (19) strikes a minor (17), the state becomes the complainant even if the minor does not want to pursue charges.
Same with a husband who strikes his wife and whether or not she wishes to pursue charges, the state will.
The officer did not make that decision, the decision is made by the statues of the law....
As to the date of March 24, I can't tell you ... you might need to find an attorney.
Good LuckSeeking Legal Advice. Cops mistake used against me.?
The best advice I can give you is to see an attorney and you are running out of time fast.
Well, you are in trouble if you have no way to prove nobody told you about the court date.
You are an adult now, you may need a lawyer
The cop didn't hit your brother, you did. It was your mistake that got you in troublem, not the cop's.
If you turn yourself in you will be arrested and released later on your own recognizance. They do not have to tell you that you have a warrant and will oftentimes trick you into showing up at the police department to find out if you do have a warrant. They will arrest you on the spot...i guarantee it. Get it over with because they will find you.
